Terms of Service

DBA
This Service Rogue Books Publishing is provided by Joel M. Bowers DBA and hereafter referred to as Rogue Books in these terms.

Privacy
All information of a personal or confidential nature gathered by Rogue Books through the Service, such as contact information including e-mail address, shall under no circumstances be divulged to any third party without the express permission of the affected individuals, unless required to do so by law.

Non-exclusive Rights
You hereby grant Rogue Books the non-exclusive right to publish and market your submitted manuscript if accepted. You continue to own the copyright for all materials submitted and published on Rogue Books.

Copyright Infringement
You guarantee and warrent that all material submitted to Rogue Books for publication is wholly owned by you as the submitter and is not in any way plagiarization of any other work or in any way violate the copyright of any other work, both in wording and imagery.

You further agree to not hold Rogue Books liable in any way for any plagiarization or copyright infringement resulting from the publication of any and all submitted manuscripts. It is also known and agreed that Rogue Books will in no way knowingly infringe on or facilitate any infringement of any copyright of work submitted to the service to the best of our ability. This not withstanding, you continue to agree to hold Rogue Books not liable for any infringement that may happen.

Content Not Accepted:
The following types of content are prohibited and will not be accepted:

• Children's Literature
• Paranormal
• Graphic Horror
• Excessive Explicit Language
• Erotica
• Graphic Sex
• Plagiarism
• Work that is slanderous
• Promoting conspiracy theories
• Hateful Speech

As Is Only
There is no warranty or guarantee of any kind with respect to the Service as far as reliability, stability, quality or dependability. This means that Rogue Books cannot be held liable or responsible for any loss or damage incurred directly or indirectly due to the use of the Service. This shall include, but is not limited to, any system malfunction, period of being inoperative or unavailable, loss of data or discontinuation of service.

It is understood that use of the Service is entirely at your own risk.

No Misuse
You agree to in no way attempt to hack the system or take action that would cause a disruption of service. Any member deemed to be abusing the system will have their membership disabled at the sole discretion of Rogue Books.

No Spam
Using the Service in connection with any type of unsolicited email or email that would commonly be perceived as being unsolicited email is strictly prohibited. You agree to use links to the Service in emails only if the recipient of the email has agreed to receive such email. Sending to any type of safe list is NOT acceptable. Members found to violate this No Spam Tolerance clause will have their membership terminated and disabled immediately. All stories submitted will be deactivated immediately. This rule applies to all forms of spam, including forum or social media posts or submission of contact forms with spam meaning what is commonly viewed to as unsolicited email or posts.

Support
30 minutes of e-mail support is included with each each membership. Beyond that, the fee will be $100 per hour billed in 30-minute increments.

Any support that requires the modification of the system for customization to accommodate a specific need will be bid on a per job basis. Note: modifications made at the request of a user to fix an error or bug in an already existing algorithm will incur no fee.

Data Retention
All click reporting data will be retained for a minimum of six months. Click data older than six months may be purged from the database periodically.

Monetization
You agree that any monetization of submitted works will be split between Rogue Books and the owner of such submissions at the rate of 30% to Rogue Books and 70% to the author or creator of submitted works. You further understand that all submitted content will be free to download.

Arbitration
In the event that a user of the Service feels they have a grievance against Rogue Books or associates with respect to the Service, such user agrees to first express such grievance to Rogue Books by contacting via the contact form with the intention of coming to an equitable solution. In the event that such a solution is not forthcoming, the user agrees to resolve the situation through arbitration.

Termination
Rogue Books may discontinue access to the Service for individual or all users at our sole discretion and cannot be held liable for any loss or inconvenience caused by such action. Members may likewise terminate their membership at any time.

It is also understood that any submitted manuscripts may be rejected by Rogue Books for any reason and such decision is final. It is also understood that any material already accepted and publicized by Rogue Books my be disabled or entirely removed for any reason and at any time at the sole discretion of Rogue Books. Rogue Books cannot be held responsible for any loss incurred as a result of such removal or deactivation.

Remedies
In the event that an individual misuses the Service in violation of these terms of use, that individual shall be prohibited from further access to the system at the sole discretion of Rogue Books. Furthermore, if the violation of these terms results in any type of loss to Rogue Books or associates or to any other users of the Service, monetary or otherwise, or the disruption of service, it is understood that the responsible individual or entity that was in violation shall be held entirely responsible for any such loss and that Rogue Books shall take appropriate legal action to recover losses incurred.

No Implied Endorsements
In no event shall any reference to any third party or third-party product or service be construed as an approval or endorsement by Rogue Books of that third party or of any product or service provided by a third party.

Subject to Change
These Terms of Service are subject to change at the discretion of Rogue Books. Your continued use of the Service indicates your continued acceptance of this agreement.
